Destruction of Hazardous Imports Act

This bill gives the FDA more power to order the destruction of imported foods, drugs, medical devices, tobacco products, and cosmetics that are turned away from entering the United States because they pose a serious public health concern. Right now, many refused items can be sent back to the country they came from, and only certain low-value items can be destroyed, but this bill would allow the FDA to order the destruction of any refused item that is a significant health risk, regardless of its value. The owner of the item would have to pay for destroying it within 90 days, and anyone who tries to move or export the item after a destruction order is issued could face a fine, up to one year in prison, or both. The bill also requires the FDA to create rules that protect the rights of item owners, including giving them notice and a chance to respond before their products are destroyed.
