NO FAKES Act of 2026

This bill creates a new federal right that protects people from having their voice or appearance copied digitally without their permission, such as through the use of artificial intelligence. The right to control these digital copies cannot be sold during a person's lifetime, but it can be licensed to others, and it continues even after the person dies. Anyone who creates or shares an unauthorized digital copy of someone's voice or likeness could be sued and face penalties, though certain uses like news reporting, sports broadcasts, and satire are allowed. The bill also sets up a system for requesting the removal of unauthorized digital copies and for challenging those removal requests, and it generally replaces state laws on this topic except for state laws that already existed before January 2, 2025.
