Protecting Patients from Deceptive Drug Ads Act

What this bill does

AI plain-language summary

This bill creates penalties for social media influencers and health care providers who post false or misleading information about prescription drugs on social media when they are being paid to do so. It also requires that social media posts and telehealth ads promoting prescription drugs include important safety information, like side effects and warnings, just as other drug advertisements must. Any payments from drug companies to health care providers or social media influencers for promoting prescription drugs must be reported under existing anti-kickback laws. The bill also allows the FDA to monitor how prescription drugs are being promoted on social media and to work with the Federal Trade Commission on that effort.
