Farmers Freedom Act of 2025

This bill would make it so that certain farmland that was converted from wetlands before December 23, 1985, does not need special permits under the Clean Water Act. However, if that land has gone back to being wetlands and hasn't been used for farming in five years, it would still need permits. The government has gone back and forth on the rules about which converted cropland counts as protected waterways, so this bill puts a clear definition of "prior converted cropland" directly into the law to settle the issue. The bill's definition is broader, meaning more farmland would be excluded from Clean Water Act permit requirements.
