Congressional Records Protection Act of 2026

This bill would generally stop the government from using search warrants, subpoenas, court orders, or similar legal tools to collect records belonging to Members of Congress or their employees that were created or shared as part of their official work. However, there are exceptions — the government can still go after these records if the person whose records are being sought is the target of a criminal investigation, or if the records involve certain electronic communications. When the government does collect congressional records under one of these exceptions, it must notify the affected Member of Congress or employee and wait 30 days before reviewing the materials. In some cases involving electronic communications providers, a special master must be appointed to sort out which materials are protected from being disclosed.
