Title IX Clarification Act of 2026

This bill changes Title IX — the law that bans sex discrimination in schools that receive federal funding — by adding specific definitions for the words "sex," "female," and "male." Under the bill, "sex" means a person's biological sex, and the definitions of "female" and "male" are based on a person's reproductive system and the type of reproductive cells (eggs or sperm) their body is designed to produce. The bill also notes that a January 2025 executive order established a U.S. policy of recognizing only two sexes, male and female, and that the Department of Education announced it would enforce Title IX in line with that order.
